DRAFT SCOPING DOCUMENT (Proposed Asphalt Batch Plant)

Updated information: 

A sumary of the Draft Scoping Document for a Draft Environmental Impact Statement (DEIS), New York State environmental Quality Review Act (SEQR) on a proposed Asphalt Batch Plant, Hinckley Road, (East Side), North of County Route 47, Town of Russia, Herkimer County, New York.

The Planning Board has completed a Scoping Document for the preparation of a Draft Environmental Impact Statement for Material Sand and Gravel's proposed hot mix asphalt plant.  The Scoping Document is available for review.

Meanwhile, court actions are proceeding on the proposed facility.  A number of citizens are challenging the decision of the Zoning Board to allow the facility as an expansion of mining.  Material Sand and Gravel is also challenging the decision of the Zoning Board, stating that no additional approvals should have been required for the proposed plant.  Material Sand and Gravel is also asking that the citizens' lawsuit be dismissed.  No action is expected on these cases until at least January.
